No one — absolutely no one — can enter without your permission.
Not an ex-partner.
Not a spouse you’re separated from.
Not someone who “used to live there.”
Not someone who thinks they still have a right to it.
If they enter your home without consent, they are committing a criminal offence:
allanamiento de morada (trespassing).
And if you have:
• a restraining order (orden de alejamiento)
• an ongoing denuncia
• a VioGén file
• or any form of legal protection
…the consequences for them are even more severe.
📌 What the Law Says (Spain)
Article 18 of the Spanish Constitution:
Your domicile is inviolable.
Entry or search requires your consent or a court order.
No exceptions for ex-partners, separated spouses, or past residents.
If your abuser tries to:
• enter your home
• force entry
• appear at your door
• ring the bell repeatedly
• intimidate you outside your building
→ Call 112, 091 (Policía Nacional), or 062 (Guardia Civil).
This becomes both trespassing and a violation of your restraining order.
🛑 If You Have an Order of Protection (Orden de Protección):
The law is even clearer:
Any approach to your home is an automatic crime.
Distances are strict:
Your doorway, hallway, garage, portal, stairwell — all count as your space.
You do not need to “prove fear.”
Their presence alone is enough.
