Protection Continues

In Spain, police protection from the Guardia Civil or other police forces can continue after a divorce, but it does notautomatically continue simply because the divorce has been finalized.

Instead, protection depends on the ongoing level of risk, not on whether you are still married. Factors that are considered include:

  • Whether there have been previous incidents of domestic abuse or threats.
  • Whether there are restraining or protection orders still in force.
  • Current risk assessments carried out by the police (such as the VioGén system).
  • Any new harassment, stalking, intimidation, or breaches of court orders.

If the authorities assess that there is still a significant risk to your safety, police protection or monitoring can continue after the divorce. If the risk level changes, the protection may be adjusted accordingly.

If you are currently under the protection of the Guardia Civil and your divorce is nearing completion, you can ask the officer or victim support service managing your case what will happen after the final decree. They can explain whether your protection measures will remain in place and whether a new risk assessment is planned.

The key point is that the end of the marriage does not automatically mean the end of police protection. Your safety and the assessed level of risk remain the deciding factors.
