Subject: Discovery of a Suspected Hidden Camera Inside My Home

I wish to file a denuncia regarding the discovery of a suspected hidden camera inside my residence.

Facts:

  • I discovered a device that appears to be a hidden camera on/in: (describe exact location).
  • I did not touch, move, or tamper with the device.
  • I documented the scene with photographs and/or video showing the device exactly as found.
  • The device may contain fingerprints, serial numbers, and potentially stored recordings.
  • I have attached/provided all photographic evidence and any relevant messages, suspicious behaviour, or prior incidents.

Risk and Context:

  • I believe this situation may constitute a violation of privacy and possibly domestic or gender-based violence–related offences.
  • I request that the cybercrime unit (Grupo de Delitos Telemáticos) analyse the device and conduct a full investigation.

Request:

  • That the police collect the device as evidence.
  • That an investigation be initiated to determine who installed the camera, whether images were recorded, and whether the footage has been shared or stored.
  • That protective measures be evaluated if there is any risk to my safety.

Subject: Complaint for Potential Illegal Recording and Violation of Personal Data Rights

I am submitting this complaint to the AEPD regarding a suspected illegal recording device discovered inside my home.

Summary of Events:

  • A device resembling a hidden camera was found on/in: (describe exact location).
  • The device appears capable of recording images and/or sound without my knowledge or consent.
  • I have photo and video documentation of the device exactly as found, without manipulation.
  • I believe my personal data — including images, audio, or activities inside my home — may have been captured unlawfully.

Rights Potentially Violated:

  • Article 6 GDPR — lack of lawful basis for data processing.
  • Article 7 GDPR — absence of valid consent.
  • Article 5 GDPR — unlawful, excessive, and clandestine data collection.
  • Articles 12–22 GDPR — infringement of my rights as a data subject.
  • Article 89 LOPDGDD (Spain) — protection of image and privacy in the domestic sphere.

Request to the AEPD:

  • That the Agency investigate whether image or audio data were collected without consent.
  • That the AEPD identify the data controller responsible (if possible).
  • That any illegal data processing be ordered to cease, and any recordings be secured or deleted.
  • That sanctions or measures be applied if unlawful data processing is confirmed.

I attach photographs, descriptions, and any evidence indicating who may have installed the device or accessed the recordings.
