You are reporting vigilancia, grabación y acoso using a security camera system without your consent.
Use this language when speaking to police:
“Estoy siendo vigilada y grabada sin mi consentimiento mediante un sistema de cámaras de seguridad.”
“El sistema se ha utilizado para controlarme / seguir mis movimientos.”
“Esto me ha causado miedo, alteración de mi vida diaria y pérdida de privacidad.”
Relevant criminal offences (Código Penal)
Depending on the facts, this may fall under multiple articles:
🔴 1. Violation of privacy – Artículo 197
Applies if:
- Images or recordings were captured without consent
- You were recorded in private spaces (home, entrances, daily movements)
- Cameras were used beyond legitimate security purposes
This is a serious offence, even if the system is “in their name”.
🔴 2. Stalking / harassment – Artículo 172 ter
Applies if:
- Surveillance was repeated or continuous
- It altered your daily life (fear, changing routines, avoiding spaces)
- It formed part of control or intimidation
You do not need physical following — digital surveillance counts.
🔴 3. Coercive control / abuse context
If this happens alongside:
- Data wiping
- Locking you out of systems
- Withholding car keys
- Monitoring movements
Police and courts increasingly recognise this as a pattern of coercive control, especially in intimate relationships.
Evidence to bring (very important)
🔹 A. Proof of surveillance
Bring any of the following:
- Screenshots of camera feeds
- App screenshots showing live or recorded access
- Notifications (“motion detected”, access logs)
- Camera placement photos (especially if pointed at private areas)
If you don’t have access anymore, say:
“El acceso fue retirado después de haber sido grabada.”
That matters.
🔹 B. Proof of lack of consent
- Messages where you objected or asked for cameras to be turned off
- Absence of any written consent
- Proof cameras were installed/used without informing you
🔹 C. Pattern evidence (very strong)
Bring the combined timeline:
- Computer wiped
- Security system locked
- Car key withheld
- Camera surveillance
This shows intent and repetition, not an isolated incident.
🔹 D. Impact on you
Write down:
- Fear, anxiety, sleep disturbance
- Changes to routine (avoiding rooms, leaving home, etc.)
- Any witnesses (friends, family) who noticed distress
You don’t need a diagnosis — your testimony is evidence.
What to ask police to do
You can ask (calmly and clearly) for:
- The denuncia to include stalking (art. 172 ter) and privacy violation (art. 197)
- Preservation of camera footage and access logs
- Investigation into who accessed the system and when
- Consideration of protective measures if you feel unsafe
If needed, say:
“Solicito que se investigue como acoso y vulneración de mi intimidad.”
What NOT to do
- ❌ Do not disable or destroy cameras yourself (unless police instruct you)
- ❌ Do not confront him about surveillance
- ❌ Do not access accounts that are not legally yours
