How is property divided in a divorce in Spain?

In addition, all assets that either spouse obtained during the marriage (whether purchased or inherited) will also be included in a common group of assets. Therefore, on divorce using the community of property regime, each spouse will retain 50% of the common assets.

Spanish common law (the código civil) considers that any gains, benefits and assets that either spouse acquired, purchased or inherited before and during the marriage will become common assets. If the código civil applies to your divorce case, expect for each spouse to retain 50% of the property rights.

October 2024 – 32 years married – Mr Turner never worked – Mrs Turner worked for 30 years

Mr. Turner’s lawyer tells me that he would be willing to sign an amicable divorce with the agreement of the sale of the house but he gets 65% of the sale price and you get 35%. And they also say that if we don’t reach an agreement, Mr Turner will claim the entire property.

Good afternoon Linda,

I have just received an email from Mr. XXXXXXX lawyer saying that he AGREES TO SELL THE HOUSE but asks for the following:
– He keeps the dog
– You must withdraw the complaint and court proceedings
– The house is put up for sale in several real estate agencies, which will have to provide a valuation of the house.
– He doesn’t pay for the house until the restraining order is terminated, for the time being until March, as he cannot live in the house
