FORMAL NOTICE – INVOLABILITY OF MY HOME (SPAIN)
This notice is issued to formally assert my legal rights under Spanish law.
Under Article 18.2 of the Spanish Constitution, my home is inviolable:
“El domicilio es inviolable. Ninguna entrada o registro podrá hacerse en él sin consentimiento del titular o resolución judicial, salvo en caso de flagrante delito.”
(The home is inviolable. No entry or search may be made without the consent of the occupant or a judicial warrant, except in cases of flagrante offence.)
Accordingly, no person — including [his name] or any member of his family, associates, or representatives — has any right whatsoever to enter, approach, access, attend at, or attempt to gain entry to my home or property at any time, for any reason, with or without the existence of a restraining order.
This prohibition applies equally to:
- Physical entry
- Attendance at the property boundary
- Attempts to gain access by intimidation, pressure, or third parties
- Claims of entitlement based on family, prior relationship, or assumption
Any entry or attempt to enter without my explicit written consent will constitute unlawful entry (allanamiento de morada) and will be reported immediately to the Policía / Guardia Civil and pursued through the courts.
This notice is issued without prejudice to any current or future civil or criminal proceedings and is intended to place all parties on formal notice of my legal position.
There will be no warnings, no discussion, and no exceptions.
